It is very important to be correctly represented prior to the execution of any document related to the purchase of any property in Mexico, to avoid any scams or complications further in the process. One of the main items to consider is carrying out a legal due diligence over the respective property.
Once you have found the property and confirmed it has no legal issues, the process towards incorporating a Mexican Trust, and understanding all of the corresponding particularities and steps, can be a little overwhelming. I have over 15 years assessing foreign clients in the acquisition of their beachfront properties, taking them by the hand in this process, so that they feel secure that their investment is protected.

Due Diligence over the desired Property / Issuance of Title Report. This will help you identify any title issues or defects that could put your investment at risk, or result in future expenses.

Confirmation at Public Registry of Property and other applicable authorities on status of ownership, liens and encumbrances.

Review and assessment on seller to confirm that seller is the legal owner, and that seller has the legal capacity to transfer the property.

Review and assessment on all acquisition documents, (e.g. Offer to purchase, preliminary purchase agreement, trust incorporation deed, among others).

Assistance with the incorporation of a new trust or the assignment of trust rights agreement, as applicable (including required filings with authorities, notary public and trustees).

Preparation and assistance with escrow documents, when applicable.

Closing Coordinator services. Coordination and assistance on execution of all closing documents, including but not limited to title deed, escrow documents, ancillary documents.
